- Introduction
Your agreement is with Nadia Coplestone who delivers your training/class tuition.
These Terms and Conditions form part of your agreement with Nadia Coplestone.
Your instructions to commence personal training or class tuition will constitute acceptance of these Terms and Conditions when you will become a client (a “Client” or “you”).You are asked to pay special attention to the provisions related to liability and cancellations. This does not affect your statutory rights.
- Trainer
Your Trainer, Nadia Coplestone is a fully qualified personal trainer (accredited on the Register of Exercise Professionals as at least Level 3).
- Trainer’s Obligations – Personal Training
a.) Nadia Coplestone will use her skills and knowledge to design a safe programme of exercise that will take into account your lifestyle, personal goals, fitness levels and medical history.
b.) Nadia Coplestone will provide the coaching, supervision, advice and support that you will need to achieve your goals. Apart from the initial consultation (and the first personal training session if taken immediately afterwards) each personal training session will last 60 minutes (a “Session”).
c.) You understand that the results of any fitness programme cannot be guaranteed. Your progress depends on your effort and co-operation in and outside of the Sessions. In particular you acknowledge that individual results may vary and no particular result is guaranteed by your Trainer.
d.) All Client information will be kept strictly private and confidential.
- Your Obligations -Personal Training
a.) It is understood between you and your Trainer that both must commit to your training programme 100% in order for you to achieve results.
b.) You are required to arrive on time for each Session so that the Trainer’s full training plan is achieved on each visit.
c.) You are required to wear appropriate clothing and footwear.
d.) You are required to complete a Physical Activity Readiness Questionnaire (a “PARQ”) and disclaimer form before undertaking your first personal training session.
e.) Your Trainer may require a letter of ‘medical clearance’ from your GP. Please be aware that your GP may charge for providing this letter.
f.) You understand and agree that it is your responsibility to inform the Trainer of any conditions or changes to your health, now and on-going, which may affect your ability to exercise safely and with minimal risk of injury.
g.) If your Trainer requires further medical information from a practitioner, you must provide such details.
h.) You understand that there are inherent risks in participating in a programme of strenuous exercise. If you sustain or claim to sustain any injury while participating in training, you acknowledge that the Trainer is not responsible, except where the injury was caused by her gross negligence or intentional act.
i.) Your Trainer cannot be held liable in any way for undeclared or unknown medical conditions.
j) You as the client agree that Amazonian Health and Fitness Ltd is in no way responsible for the safekeeping of your personal belongings while you are present at our premises. You assume all risk of loss or damage to any of your personal belongings.
- Payment – Personal Training
a.) Payment for Sessions will be invoiced and must be paid vis BACs or Cash payment when stated on invoice.
b.) We accept most credit cards which are processed through the online payment gateway Stripe (www.stripe.com/gb) or Paypal.
- Cancellation and Refunds – Personal Training
a.) 24 hour’s notice of cancellation or postponement is required for all appointments.
b.) Notice of less than 24 hours will incur full payment of the full Session fee.
c.) Unforeseen events will be taken into consideration on the day.
d.) Once booked, your Sessions are non-refundable and non-transferable.
7. Booking of online classes
a) Nadia Coplestone will use her skills and knowledge to design a safe class programme of exercise that will take into account varied fitness levels.
b) If the client is late, the session may have already started and the client is responsible for their own warm up and the increased risk of injury from not fully partaking in the warm up at the beginning of the class.
c.) You must be over 16 and a ‘consumer’ to book and attend any Class at Amazonian Health and Fitness Ltd.
d.) Your place in that Class is subject to availability. No priority is given but every provision is made by Amazonian Health and Fitness Ltd to provide enough fitness classes to accommodate all requests.
e.) You must be dressed appropriately for exercise with well fitting trainers suitable for the Class you are attending. As classes are pridominantly outside, you will need to wear clothing suitable for the elements. Loosely swinging or sharp jewellery should be removed before a Fitness Class. If you do not comply with any of these dress requirements, you may not be allowed to participate in the Class.
f) Minors may accompany clients as long as the client fills in relevant forms on arrival and understands the rules regarding health and safety and responsibility.
g) You as the client agree that Amazonian Health and Fitness Ltd is in no way responsible for the safekeeping of your personal belongings while you are present at our premises. You assume all risk of loss or damage to any of your personal belongings.
8. Cancellation and Refunds – Class Bookings Online
a.) 48 hour’s notice of cancellation or postponement is required for all bookings.
b.) Notice of less than 48 hours will incur a cancellation fee equivalent to the full price of the class.
c.) Unforeseen events will be taken into consideration on the day.
d.) Once purchased, class bookings can be moved to another session given 48 hours notice and dependent on class availability.
9. Term Class Booking
a) The class term booking is for the period of the Term stated on the booking only.
b) You are only able to access the maximum of classes purchased throughout the term but you are able to choose to book the classes whenever you wish over the Term period, subject to availability on the day of purchase.
c) Once purchased you will be contacted within 24 hours to confirm classes you wish to book, this will be subject to availability.
d) Clients who book termly are unable to use loyalty cards due to a 5% discounted bulk purchase rate.
e) Classes are non refundable and cannot be rescheduled outside of the term period you have purchased.
f) Classes cannot be rolled over into the following term. Rescheduling will only be accepted with 48 hours prior notice to the class commencing.
g) Classes cannot be traded with other clients unless agreed with Nadia Coplestone.
h) If you miss a class you have booked you will incur full cost of the class with no refund.
11. Lateness Policy
a.) If the client is late the Session cannot be extended and will end at the appointed time.
b.) If the Trainer is late additional time will be added to the Session or to subsequent Sessions.
12. Liability
a.) An agreement, release and waiver of liability will need to be read and signed before partaking in any class or personal training sessions.
13. Intellectual Property
a.) Any marketing, educational or other materials, including the Company’s programmes and/or any variations thereto and its nutrition services materials, made available to you will at all times remain the property of the Company and is subject to copyright.
b.) You undertake to use such materials only for your own personal development and not to copy, publish or reproduce any such materials.
14. General
a.) The Trainer has the right to change these Terms and Conditions, for example, to be able to offer new services or as required by law. The Trainer will notify you of any change. When such a change(s) is made, if dissatisfied you can cancel this agreement once you have made any payments already due to the Trainer.
b.) You are responsible for keeping all your contact information and marketing preferences up to date with the Trainer. In order to comply with the Data Protection Act 1998, the Trainer will only do what you ask her to do, or what you have given her permission to do with any personal or sensitive information held about you.
c.) Your training may be filmed or pictures taken for marketing purposes. Your participation in a Session means you consent to photography, filming and sound recording which may include you as a Client and its use in commercial distribution without payment or copyright.
d.) This agreement is governed by the laws of England and Wales and is subject to the jurisdiction of the English courts.
